Right of Withdrawal for Consumers

(A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional.)

Instructions on Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us (Snow Business GmbH, Friedrich-Ebert-Damm 202a, 22047 Hamburg, Germany, Phone: +49 (0) 40 27805434, Email: info@wintereffects.com) by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient that you send the communication regarding the exercise of the right of withdrawal before the withdrawal period expires.

Effects of Withdrawal

If you withdraw from this contract, we must reimburse all payments received from you, including delivery costs (except for the additional costs arising if you chose a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided proof that you have sent back the goods, whichever is earlier.

You must return or hand over the goods to us immediately and, in any case, no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You bear the direct costs of returning the goods. You are only responsible for any diminished value of the goods if this loss in value is due to handling the goods beyond what is necessary to inspect their condition, properties, and functionality.

Exclusions or Expiration of the Right of Withdrawal

The right of withdrawal does not exist for contracts:

  • for the delivery of goods that are not prefabricated and for the production of which an individual choice or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

The right of withdrawal expires prematurely for contracts:

  • for the delivery of goods if these goods have been inseparably mixed with other goods after delivery due to their nature.
